Delhi High Court Stays Eviction of Gosiya Slum Colony Residents

On 14th February, 2023, in a major relief for the residents of Gosiya Slum Colony in Mehrauli, the Delhi High Court granted a stay on the eviction notice issued by the Delhi Development Authority (DDA). The stay comes in response to a petition challenging the eviction notice served on December 12, 2022.

Background of Gosiya Slum Colony
Situated in Ward No. 8, Mehrauli, Delhi-110030, the Gosiya Slum Colony has been in existence for over 50 years. The colony is home to more than 700 houses, with an estimated population of 4,000 individuals. Most residents are daily wage workers, with 35-40% of the women employed as domestic workers. Other residents work as auto or taxi drivers, street vendors, electricians, plumbers, gardeners, and construction workers.

The Eviction Notice
On December 12, 2022, the DDA served an eviction notice to the residents, directing them to vacate their homes. The notice caused widespread concern among the community, many of whom rely on their proximity to urban areas for their livelihoods.

Legal Action
In response to the eviction notice, a case was filed challenging the DDA’s notice. The petition argued that the colony has been in existence for over 30 years and serves as a vital residence for hundreds of families who contribute significantly to the city’s workforce. Most of the residents are eligible for rehabilitation under the Delhi Slum & JJ Rehabilitation and Relocation Policy, 2015.

High Court Intervention
On February 14, 2023, the Delhi High Court issued notice to the DDA regarding the petition and granted an interim stay on the eviction. This order provides temporary relief to the residents, allowing them to remain in their homes while the matter is under judicial consideration.
