Delhi High Court Grants Protection to Same-Sex Couple Facing Threats

In July, 2024, in a case highlighting the challenges faced by same-sex couples in India, the Delhi High Court granted protection to a couple who had sought safety from threats of violence by the family of one of the petitioners. The family of Petitioner No. 1 had allegedly threatened to kill the couple, even brandishing a gun to intimidate them.

The petition was filed seeking police protection for the couple and the minor son of Petitioner No. 2. The petitioners argued that their lives and liberty were at grave risk due to the opposition of Petitioner No. 1’s family to their relationship.

The court noted in its order that:

“In the event that the petitioners are in Delhi and they perceive any threat from the family of Petitioner No. 1, they shall communicate the same to the concerned Investigating Officer, who shall take steps to provide security/protection to the petitioners.”

This case underscores the legal and social challenges faced by same-sex couples in India, despite the decriminalization of homosexuality in 2018. While the court’s intervention offered temporary relief, it also highlighted the broader need for societal acceptance and legal protections for LGBTQ+ individuals.
